Welcome to Rapsodee.org (“Rapsodee,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, and any related content or features (collectively, the “Services”). By accessing or using the Services, including purchasing a video biography slideshow, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
We may update these Terms from time to time. We will notify you of material changes via email or a site banner at least 30 days in advance. Your continued use after changes constitutes acceptance.
1. Description of Services
Rapsodee provides custom video biography services that transform your personal stories, audio recordings, and photos into heirloom-quality videos. Services include:
- Guided audio interviews (30-90 minutes based on tier).
- Professional audio editing (e.g., removing fillers words and pauses).
- Photo integration and vivification, animating images for dynamic effects (certain tiers only).
- Full transcription (certain tiers only).
- Delivery as a private YouTube link, which you own outright for download and sharing.
Timelines: 2-4 weeks from interview to delivery. We do not provide physical products, legal advice, or guarantees of emotional outcomes. Services are subject to availability and may be modified.
2. User Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Services. To access features like uploads or payments, you may need to create an account via our site. You agree to provide accurate information and keep your password secure. You are responsible for all activities under your account. We may suspend or terminate accounts for violations (e.g., false info, misuse).
3. Payments and Billing
Pricing: Bronze ($149.99), Silver ($299.99), Gold ($549.99), subject to change. All payments are processed securely via commercial finance services such as Stripe or PayPal. Prices exclude taxes, which you agree to pay. No hidden fees, but upgrades (e.g., extra transcription or vivified photos) may apply. Payments are non-refundable except as outlined in the Refund Policy below.
4. User Content and Intellectual Property
By submitting content (e.g., photos, audio, narratives), you grant Rapsodee a non-exclusive, royalty-free license to use, modify, and reproduce it solely to provide the Services. You retain ownership of your content, but we own the final video biography slideshow (you receive perpetual rights to use/share it). Represent that your content doesn’t infringe third-party rights and complies with laws (e.g., no illegal material). We may delete content if it violates these Terms. Rapsodee owns all site content, trademarks (e.g., “Rapsodee”), and IP; you may not copy or use them without permission.
5. Refund and Returns Policy
As a digital, personalized service, returns are not applicable once delivered. However, we offer refunds to ensure satisfaction:
- Full Refund (100%): Within 14 days of purchase if no interview has occurred and no materials (e.g., photos) have been submitted. Request via [email protected]; processed within 7-10 business days to original payment method.
- Partial Refund (50-75%): Post-interview but pre-delivery for cancellations (deducts costs for time/materials). Not available if production has started (e.g., editing).
- Defect-Based Refunds or Revisions: If the final video has technical defects (e.g., audio errors, not matching tier specs), we offer one free revision round within 7 days of delivery. If unresolved, a full or partial refund may apply at our discretion. No refunds for subjective dissatisfaction (e.g., “not emotional enough”) or user errors (e.g., poor-quality photos).
- No-Show/No-Upload Policy: If you fail to schedule/upload within 30 days, we may cancel and issue a partial refund (minus admin fees).
- Gifts: Refunds follow the same rules; notify us if gifting.
All refund requests must be in writing with details. We aim for fair resolutions but reserve the right to deny abusive claims. This policy complies with e-commerce standards and does not affect your statutory rights.
6. Privacy and Data Security
Your privacy is paramount. We handle sensitive data (e.g., voices as biometrics) per our Privacy Policy, incorporated herein by reference. 7. Limitations of Liability and Disclaimers
Services are provided “as is” without warranties. We disclaim implied warranties (e.g., merchantability, fitness). Rapsodee is not liable for indirect damages (e.g., lost data, emotional distress) or amounts exceeding fees paid. Total liability capped at your payment amount. We are not responsible for third-party issues (e.g., YouTube downtime).
8. Termination
We may terminate your access for violations (e.g., non-payment, abuse). Upon termination, you lose access to undelivered services; no refunds unless per policy.
9. Dispute Resolution
Disputes arise under Indiana law (U.S.). Attempt informal resolution first (contact [email protected]). If unresolved, binding arbitration in Indianapolis, IN, via AAA rules (you waive class actions).
10. Governing Law
These Terms are governed by Indiana and U.S. federal law, without regard to conflicts.
11. Miscellaneous
If any provision is invalid, others remain enforceable. No waiver unless in writing. These Terms constitute the full agreement.
